Green Card Through Your Employment Skills and Abilities

Immigrating to the U.S. based on employment is determined by your abilities, exceptional talents, training, skills, and investment capacity.​ Under the Employment-Based Immigration, a noncitizen may immigrate to the United States and become lawful permanent resident if s/he falls under any of the following categories​​​:

EB-1 Visa Priority Workers​

EB-2 Visa​ Advanced Degrees Professionals

EB-3 Visa​ Skilled Workers, Professionals, and other Workers
-
EB-4 Visa​ Special Immigrants
-
EB-5 Visa Investors/Entrepreneurs
​
U.S. employer must:
-
first obtain an approved Permanent Labor Certification (PERM) from the Department of Labor (DOL) for petitions under EB-2 and EB-3 visa categories;
-
file a Form I-140, Petition for Alien Worker; and
-
be able to demonstrate a continuing ability to pay the offered wage as of the priority date.
EB-1 Visa: Priority Workers

Under the EB-1 Visa category, if you are a noncitizen with:
​
Extraordinary Ability
-
You must demonstrate sustained national or international acclaim and that your achievements have been recognized in your field of expertise.
-
You must plan to continue working in the U.S. in the area of your expertise when you immigrate to the United States.
​
Outstanding Professors and Researchers
-
You have international recognition for your outstanding achievements in a particular academic field.
-
You must have at least 3 years experience in teaching or research in that academic area.
​
Certain Multinational Manager or Executive
-
You must demonstrate that you have been employed outside the United States for at least 1 year in this professional role.

EB-1 Visa is not subject to Labor Certification. Thus, you do not need a job offer or employer to apply for an EB-1 Visa, you can self-petition by filing Form I-140, Petition for Alien Worker.


EB-2 Visa: Advanced Degree
Advanced Degree
​As an EB-2 applicant with an advanced degree or its foreign equivalent (i.e a baccalaureate), you must apply to a job that requires an advanced degree.
​
Exceptional Ability
If you are applying as an applicant with an exceptional ability, you must be able to show exceptional ability in the sciences, arts, or business.
​
EB-2 visa applicants must also meet any requirements specified on the Labor Certification as applicable as of the priority date.

National Interest Waiver (NIW)
Under the EB-2 category, you may waive the Labor Certification requirements if you are granted a National Interest Waiver (NIW). A NIW is a request that the job offer, and thus the Labor Certification, be waived because it is in the interest of the United States. If you are seeking a NIW, you may self-petition for your EB-2 Visa because a waiver means you do not need an employer or job offer.
EB-3 Visa: Skilled Workers
You may be eligible for EB-3 immigrant visa if you are a skilled worker, professional, or other worker and are performing work for which qualified workers are not available in the United States. You must also meet any other job requirements specified on the Labor Certification.

Skilled Worker must:

demonstrate that you possess at least 2 years of job experience, education, or training that meets the job requirements specified on the labor certification. Relevant post-secondary education may be considered as training.
​
Professional must:
-
demonstrate that you possess a U.S. baccalaureate or foreign equivalent degree, and that a baccalaureate degree is the normal requirement for entry into the occupation.
​
Other Worker (Unskilled Worker) must:
-
demonstrate the ability to perform unskilled labor (requiring less than 2 years training or experience), that is not of a temporary or seasonal nature.
